Validity

With the installation and use of the application "mobile-pocket" the user agrees to the terms of bluesource - mobile solutions gmbh. The current version of the Terms can be found on the website. Changes to Terms and Conditions will be posted here. Status of these Conditions: August 2010.

Costs

mobile-pocket provides consumer services completely for free. However, with the use of the mobile application costs can incur by data transfer over the network provider. These costs must be borne by the user. Compensation and liability claims for material or immaterial nature caused by the use or non-use of presented information or by the use of incorrect or incomplete information are strictly excluded from any claim for damages, provided by mobile-pocket no intentional or grossly negligent. Privacy Policy

By registering at mobile-pocket (storage of phone numbers, App ID and stored cards) the user agrees to accept that essential data is electronically stored and used. The transfer of these to third parties is prohibited by mobile-pocket. mobile-pocket strictly respects the laws for protection of personal data. In accordance with the Data Protection Act (DSG 2000) personal data is information that can be used to learn the identity of users. This includes information such as name, address, postal address, phone number etc. This data is only used anonymously for statistical analysis. Scope and Changes

These terms and conditions apply regardless of whether mobile-pocket is used on websites, mobile applications or in other ways. In their current version they shall regulate the relationship between mobile pocket and its registered or anonymous users. These terms and conditions apply to all content, features and other services, that are made available in the context of mobile-pocket. If users do not agree to these terms, they are not allowed to use mobile-pocket and must stop using it immediately. To fully use certain benefits of mobile-pocket it might be necessary to download software or content and / or agree to additional terms and conditions. In this case, we will timely and explicitly refer to any existing additional conditions. The use of certain services - particularly those which require a separate agreement to additional terms - can be limited to specific users and / or user groups. mobile-pocket reserves the right to adapt and change these conditions to new developments in legislation, law, technology, our service and / or for other reasons. If this could affect the interests of our users, these changes will be announced at least two weeks in advance and the users are notified via email or instant message. Continued use of the date of notification of changes plus two weeks then subjects to the new terms. If a user does not agree with changes, the use of mobile-pocket must be ceased immediately and the validity of the new terms and conditions must be contradicted within a period of two weeks. In this case, mobile-pocket is authorized to neatly terminate the contract with the user within a period of fourteen days. If mobile-pocket is still used after two weeks of the announcement, this is automatically considered as an assent to the changed new terms.

Invalid clauses

If one or more regulations of these Terms is invalid, then this does not invalidate the entire contract. The ineffective regulation is replaced by the relevant statutory regulation.

Jurisdiction and applicable law

These Terms are subject to the Austrian law excluding the UN Sales Convention (CISG) unless they contradict mandatory statutory provisions. Contract language is German. Place of jurisdiction for all claims in connection with these terms and conditions, is the headquarters of mobile-pocket or another legal place of jurisdiction of their choice. If no mandatory statute is contradicted, all disputes arising from this license agreement are handeled by the court in Vienna. For business people, public property or public law legal persons the exclusive venue for all disputes arising under this license agreement is Vienna.
